    Virginia Driver Faces Multiple Charges Including DUI And Assault

    Sometimes drivers who are arrested for DUI are also charged with other offenses. An example of this occurred recently in Woodbridge, Virginia.

    The 25-year-old defendant was placed under arrest for drunk driving after he was stopped for an alleged traffic infraction. Upon investigation, officers concluded the driver was under the influence. After the driver was transported to the police station, he allegedly hit one of the officers on the arm. The charges he now faces include driving under the influence, assault and battery on a law enforcement officer, and unreasonable refusal of a breath test.

    Driving under the influence carries serious penalties in Virginia, including fines, license suspension and possible incarceration. When other offenses are charged in addition to the DUI charge, additional penalties will come into play. Other offenses that are often charged along with DUI include assault, departing the scene of a crash, and breath test refusal.

    Unreasonable test refusal is a serious charge in Virginia. Under the state’s implied consent law, drivers are deemed to consent to DUI breath tests as a condition of being issued a driver’s license.

    In this case, a driver who was arrested for driving under the influence is accused of compounding that problem by assaulting an officer and refusing a breath test. Given the multiple offenses in this case, there are numerous options that must be considered including a negotiation of the charges and formulating a sound defense if the case goes to trial. In a situation like this, having a lawyer experienced in representing clients charged with DUI and other offenses is a real advantage.
