With the number of people who have smartphones and other devices with the capability to take photographs and videos at the touch of a button, people in Fairfax and throughout Virginia are understandably concerned about being captured when they are unaware and unwilling. This is a violation of a person's privacy and can lead to an arrest. For those who are accused of taking part in this activity, it can lead to an arrest for a form of sex offenses, especially when it involves a minor or minors. While these allegations are serious, during an investigation, those charged should prepare a strong legal defense.

According to reports, a 39-year-old man was arrested at a mall and charged with filming a teen girl who was in a store dressing room. The arrest was made right before Christmas when a woman said she spotted a device that was apparently filming her while she was in the establishment's dressing room. It was around 4 p.m. She told workers at the store. Law enforcement was called. The man was found in the dressing room of a different store. He had items that were believed to be used to film people in other dressing rooms, including a pinhole camera and Bluetooth. He was arrested for the felony of unlawfully filming a minor. He is under investigation for many more incidents and for possessing more than 100 videos of this kind. It allegedly happened at several area malls. The investigation is continuing.

Any charge related to unlawfully filming people can result in serious penalties, such as fines and prison time. When it rises to the level of a felony and the victim is a minor, the person can be confronted with child pornography and similarly problematic assertions. These cases will have an aggressive prosecution and damage to reputation simply when the charges are filed. If there is a conviction, there can be an extended jail sentence, the need to be in the sex offender registry, problems getting jobs and being admitted to schools and more.

With the allegations in this recent case raised to the level of felony because of filming a minor, the defendant should know his rights and do whatever is possible to defend himself. For this man and those who are dealing with similar claims, getting the right information about options when it comes to sex offenses and similar crimes is key.
